1. Introduction

Welcome to ArtPixLab (https://www.artpixlab.com). These Terms and Conditions (“Terms”) govern your access to and use of our website, marketplace platform, and related services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms, as well as our Privacy Policy and Cookie Policy. If you do not agree with any part of these Terms, you must discontinue use of the Service immediately.

2. Accounts

2.1 Registration

To make purchases or sell products, you must register and provide current, complete, and accurate information.
You are responsible for all activities under your account. Notify us immediately of unauthorized use.
You must promptly update any part of your information if it changes.

2.2 Eligibility

The Service is intended for users who are at least 18 years old. By registering an account or using the platform, you represent and warrant that you are 18 years of age or older. If you are under 18, you may not use this Service.

2.3 Security

You are responsible for safeguarding your password and any activities under your account.
Notify us immediately at info@ArtPixLab.com of any unauthorized use of your account.

3.User Conduct

You agree not to:

Post, upload or distribute any illegal, infringing, defamatory, obscene, or harmful content;
Interfere with the operation of the Service or bypass any security measures;
Use the Service to transmit any malicious code or spam.

We reserve the right to suspend or terminate accounts that violate these rules.

4.Intellectual Property

All content on the Service—text, graphics, logos, images, audio clips, and software—is the property of ArtPixLab or its licensors and protected by copyrights, trademark, and other laws. You may not reproduce, modify, publish, or distribute any material from our Service without express written permission.

If you believe that any content available on our Service infringes your intellectual property rights, please contact us at info@artpixlab.com with sufficient details regarding the alleged infringement.

We comply with applicable copyright and intellectual property laws, including relevant takedown procedures such as the Digital Millennium Copyright Act (DMCA), where applicable. Upon receiving a valid notice, we will promptly investigate the matter and take appropriate action, which may include removing or restricting access to the allegedly infringing content.

Sellers of AI-generated content must ensure it is lawfully created, clearly labeled as AI-generated (e.g., with a visible watermark, metadata tag, or explicit listing note), does not infringe third-party rights (including rights arising from AI training data), and complies with all applicable copyright, intellectual property, and content regulations. Sellers must provide proof of proper licensing upon request and agree to indemnify ArtPixLab against any claims or liabilities resulting from non-compliance.

5.Multivendor Marketplace

ArtPixLab operates as a platform facilitating transactions between independent Sellers and Buyers.
Sellers are solely responsible for their product listings, descriptions, pricing, shipment, and compliance with all applicable laws.
By uploading content, you represent and warrant that you own the intellectual property rights or have appropriate licenses for the content, including AI-generated works. You agree not to upload material that infringes on third-party copyrights
ArtPixLab is not a party to these transactions and disclaims liability for any disputes arising between Sellers and Buyers.
By uploading or listing content for sale, you confirm that your content does not infringe on the intellectual property rights of others and that you have the necessary rights or licenses to distribute this content internationally. We reserve the right to suspend or remove content or users in response to substantiated allegations of copyright or intellectual property infringement in any jurisdiction.

6.Platform Transparency

Fees and Commission: Our platform charges Sellers a commission of transaction plus a fixed fee for payment processing, which is stated during the payment process.
Algorithmic Ranking Criteria: Product ranking and recommendation algorithms consider price competitiveness, seller performance, and customer reviews.
Contract Termination: Either ArtPixLab or the Seller may terminate the seller agreement with thirty (30) days’ written notice.
Upon termination, sellers must fulfill all pending orders, or buyers will be refunded. Seller content will be removed within 7 days, and final commission payments will be settled within 30 days
In compliance with applicable regulations, including the EU Digital Services Act and Hungarian consumer protection and e-commerce laws, ArtPixLab verifies seller identities through [specify method, e.g., ID checks or business registration] and promptly removes illegal or prohibited content. Users can report illegal products or activities to info@artpixlab.com, and complaints will be addressed within 7 days. ArtPixLab maintains a transparent complaint log, which is accessible upon request.

7.Payments and Fees

We accept major credit cards, PayPal, and other payment methods as indicated at checkout.
Payment is processed by our third-party payment processor; see our Privacy Policy for details on data handling.

7.1Taxes

Prices displayed may include value-added tax (VAT) where applicable. For customers in regions where VAT or sales tax applies, such tax will be calculated and displayed at checkout in accordance with the applicable laws of the Buyer’s location.

For Buyers located in the United States, applicable sales tax may be calculated and added at checkout based on the Buyer’s state and local laws.

For international customers, it is your responsibility to pay any applicable customs duties, taxes, or other charges imposed by your country at the time of delivery. We provide all required documentation to assist with customs processing but are not responsible for additional charges.

It is your responsibility to ensure compliance with your local tax regulations. Where required, applicable taxes will be clearly displayed during the payment process.

Sellers are responsible for complying with all applicable tax laws in their jurisdictions, including VAT registration where required and income tax reporting. Any personal or transaction data processed for tax purposes will be handled in compliance with applicable data protection laws, including the General Data Protection Regulation (GDPR).

7.2 Wallet / Top-Up System

Users may add funds to their ArtPixLab Wallet through supported payment methods. Wallet balances are non-refundable except where required by law, and may only be used to purchase products on the platform. Wallet funds cannot be withdrawn as cash or transferred outside the Service.

8.Shipping and Delivery

Sellers set shipping methods, costs, and estimated delivery times.
Risk of loss passes to you upon delivery to the carrier.

9.Return, Refund & Cancellation

Please refer to our dedicated Return and Refund Policy for full details regarding your rights relating to cancellations, returns, refunds, and withdrawals, where applicable.

For digital content not supplied on a tangible medium, including downloadable digital artwork, you expressly agree that performance begins immediately upon download or access to the file. By doing so, you acknowledge that you may lose any applicable statutory rights to cancel or withdraw from the purchase under applicable consumer protection laws.

10.Limitation of Liability & Indemnification

The Service is provided “as is” and “as available.” ArtPixLab disclaims all warranties, whether express or implied, to the fullest extent permitted by law.
In no event will ArtPixLab be liable for indirect, incidental, special, or consequential damages.
You agree to indemnify, defend, and hold harmless ArtPixLab and its affiliates from any claims arising out of your use of the Service or breach of these Terms.

11.Governing Law & Dispute Resolution

These Terms shall be governed by and interpreted in accordance with the laws of England and Wales.

Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

For consumers residing outside the United Kingdom, nothing in these Terms shall deprive you of any mandatory consumer protection rights granted under the laws of your country of residence..

12.Dispute Resolution Mechanism

Resolution Process: In the event of a dispute between a buyer and a seller, the parties are encouraged to communicate and resolve the issue directly. If the dispute remains unresolved, ArtPixLab may provide mediation services.
Filing a Complaint: Buyers and sellers can file a complaint by contacting ArtPixLab at info@artpixlab.com. The complaint should include detailed information about the dispute, including order numbers, communication logs, and any other relevant details.
Mediation Timeline: ArtPixLab will acknowledge receipt of the complaint within 48 hours and will endeavor to mediate and resolve the dispute within seven (7) working days.
Final Decision: If mediation does not resolve the dispute, ArtPixLab reserves the right to make a final decision based on the available evidence and in accordance with our policies. This does not affect your right to pursue legal remedies or to use alternative dispute resolution bodies, including the European Online Dispute Resolution platform (https://ec.europa.eu/consumers/odr/).

13.Changes to These Terms

We may modify or update these Terms at our sole discretion. If we make material changes, we will provide at least 30 days’ notice by posting a new “Last updated” date on this page. Continued use of the Service after that date constitutes acceptance of the new Terms.

14.Content Moderation and Transparency:

ArtPixLab complies with applicable online content, consumer protection, and e-commerce regulations in the United Kingdom and other applicable jurisdictions. We promptly investigate and remove illegal or prohibited content where appropriate, maintain fair and transparent platform moderation standards, and provide a complaint mechanism at info@artpixlab.com.
